Please read these Terms of Service ("Terms") carefully before using the website www.asqcmda.com (the "Site") or enrolling in any training program offered by Alpha Training & Consulting ("we," "us," or "our").
By accessing or using the Site or our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.
Service Description
Alpha Training & Consulting provides training programs for the ASQ Certified Medical Device Auditor (CMDA) certification. Our services include but are not limited to:
- CMDA certification training courses (virtual and in-person)
- Course materials and resources
- Practice exams and study aids
- Post-course support
User Registration and Account
When you register for our training programs, you may be required to create an account and provide certain information. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
Course Registration and Payment
Registration
Registration for our training programs is on a first-come, first-served basis. Your registration is not confirmed until we receive full payment or an approved purchase order.
Payment
Payment for our training programs can be made by credit card, company purchase order, or bank transfer. All payments must be received before the course start date. All fees are quoted in US Dollars.
Pricing
Prices for our training programs are subject to change without notice. The price applicable to your purchase will be the price advertised at the time of registration.
Cancellation and Refund Policy
Cancellations by Participants
Cancellation requests must be submitted in writing to [email protected]. The following refund policy applies:
- Cancellations made more than 14 days before the course start date: Full refund minus a $100 administrative fee
- Cancellations made 7-14 days before the course start date: 50% refund
- Cancellations made less than 7 days before the course start date: No refund
Transfer to Another Course
If you are unable to attend a course, you may transfer your registration to another scheduled course within 12 months of the original course date. Transfer requests must be submitted in writing at least 7 days before the original course start date.
Cancellations by Alpha Training & Consulting
We reserve the right to cancel or reschedule training programs due to insufficient enrollment, instructor illness, or other unforeseen circumstances. In such cases, we will offer you the option to:
- Transfer to another scheduled course
- Receive a full refund of the registration fee
We are not responsible for any other costs incurred by participants (e.g., travel, accommodation) in the event of course cancellation.
Intellectual Property
Course Materials
All course materials, including but not limited to presentations, handouts, digital content, and practice exams, are protected by copyright and other intellectual property laws. These materials are provided for your personal use only and may not be:
- Copied, reproduced, or duplicated
- Distributed or shared with others
- Modified or used to create derivative works
- Used for commercial purposes
Website Content
The content on our Site, including text, graphics, logos, images, audio clips, digital downloads, and data compilations, is owned by us or our content suppliers and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from our content without our express written permission.
Limitations of Liability
To the maximum extent permitted by applicable law, in no event shall Alpha Training & Consulting, its affiliates, officers, directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from:
- The use of, or inability to use, the Site or our services
- Any content obtained from the Site
- Unauthorized access to or use of our servers or any personal information
- Any interruption or cessation of transmission to or from the Site
- Any bugs, viruses, or the like that may be transmitted through the Site
Our liability is limited to the amount you paid for the specific training program that gives rise to the claim. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
Disclaimer of Warranties
Our Site and services are provided on an "as is" and "as available" basis. Alpha Training & Consulting makes no representations or warranties of any kind, express or implied, regarding the operation of the Site or the information, content, materials, or products included on the Site.
To the full extent permissible by applicable law, Alpha Training & Consulting disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Certification Disclaimer
While our training programs are designed to help you prepare for the ASQ CMDA certification exam, we do not guarantee that you will pass the exam. The certification is awarded by ASQ based on their own criteria and examination process, which is independent of our training programs.
Indemnification
You agree to indemnify, defend, and hold harmless Alpha Training & Consulting, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:
- Your use of the Site or our services
- Your violation of these Terms
- Your violation of any rights of another
- Your conduct in connection with the Site or our services
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah.
Changes to These Terms
We reserve the right to modify these Terms at any time. The updated version will be effective as of the "Last Updated" date. Your continued use of the Site or our services after any changes to these Terms constitutes your acceptance of such changes.
